Nucleosome positioning is proposed to have an essential role in facilitating the regulated transcription of eukaryotic genes. Some transcription factors can bind to DNA when it is appropriately wrapped around the histone core, others cannot bind due to the severe deformation of DNA structure. The staged assembly of nucleosomes and positioning of histone‐DNA contacts away from promoter elements can facilitate the access of transcription factors to DNA. The recent surge of discoveries concerning the structural organization of nucleosomes, together with genetic evidence of highly specialized roles for the histones in gene regulation, have brought a renewed need for a detailed understanding of nucleosomal anatomy. Here we review recent structural advances leading to a new level of understanding of the nucleosome and chromatin fibre structure. We discuss the problems and challenges for existing models of chromatin structure and, in particular, consider how linker histones may bind within the nucleosome, (...) together with the implications of their association for the structure of the chromatin fibre. Although rhetoric might be thought of as nothing more than an archaic art of manipulation, its ability to bring about action—particularly as the intellect and will engage in acts of persuasion amid the operations of the practical intellect—is a possibility that has gone largely unnoticed among philosophers of human nature. Achieving a high quality of life is dependent upon how individuals face adversity. Positive psychological interventions are well-suited to support coping efforts; however, experimental research is limited. The purpose of the current research was to examine whether different savoring interventions could increase important coping resources in response to a social-evaluative hassle. We completed an experimental mixed subject design study with a university student sample. All participants completed a hassle induction task and were then randomly assigned into different intervention groups. Positive (...) emotion ratings were collected at three points in time. Results revealed a significant time x intervention interaction effect, such that individuals in the savoring the moment intervention reported higher levels of positive emotions compared to individuals assigned to the true control group, guided imagery control group, and savoring through reminiscence intervention. Such findings represent a significant extension to savoring theory and offer support for savoring the moment exercises as a primary prevention strategy to bolster effective responses to social-evaluative hassles. Empirical investigation of legal systems is emerging as a leading trend in both the social sciences and the legal academy in the early twenty-first century. Law reviews are now filled with studies reporting empirical data. Because empirical investigation of law commonly seeks to inform contentious social and political debates, however, its research often fuels more debate than it resolves. Partisans on both sides of contentious issues now cite the same body of research to support their reform efforts. However, social science (...) research on law is not a useless undertaking, as it can sharpen debate. But the hope that the new empirical legal studies movement will become a neutral source of information for policy makers is unlikely to be realized. (shrink)

Maciejewski’s Thomas Aquinas on Persuasion: Action, Ends, and Natural Rhetoric reveals why human nature is dependent on an internally constituted form of persuasive discourse to bring about human action. This book puts forth that use of rhetorical discourse is natural to the human person and makes possible the fullest apprehension of human goods.

This paper extracts and articulates the account of normativity in Plato’s Philebus. Central to this account is the concept of measure, which plays both an ontological and a normative role. With regard to the former, measure is what makes particular things to be the specific kind of thing they are; with regard to the latter, measure supplies the appropriate standard for determining whether or not those things are good or bad instances of their kind. The United States Fish and Wildlife Service in Alaska, USA, conducted a species status assessment for a petition to list the Alexander Archipelago wolf (Canis lupus ligoni) under the Endangered Species Act in 2020-2022. This federal undertaking could not be adequately prepared without including the knowledge of Indigenous People who have a deep cultural connection with the subspecies. Our objective is to communicate the authoritative expertise and voice of the Indigenous People who partnered on the project by demonstrating how their (...) knowledge contributed to the species status assessment. The Indigenous knowledge applied in the assessment is the cultural and intellectual property of those who have shared it. We employed rapid appraisal research to expeditiously develop a preliminary and qualitative understanding of Indigenous People's cultural and ecological knowledge of Alexander Archipelago wolves. We used semi-directed interviewing and inductive coding from grounded theory for text analysis. Indigenous knowledge contributed to the agency's understanding of the Alexander Archipelago wolf in Southeast Alaska and helped the agency with their classification decision. Indigenous research partners explained the rich cultural significance and position of wolves in Tlingit society and described human–wolf relationships and ecological interactions. The agency used a single-species assessment approach based in species ecology and conservation biology, whereas the Indigenous wolf experts applied a multi-species, community ecology approach based in a sociocultural context of balance and respect. The Indigenous wolf experts successfully addressed knowledge gaps identified by the agency. The partners were challenged by a short regulatory timeframe that did not allow for comprehensive study of Indigenous knowledge and constrained review and feedback by Indigenous experts. The United States Fish and Wildlife Service learned that its assessment framework was not designed to account for an Indigenous worldview. To level the playing field, the agency and Indigenous experts should discuss how to co-develop an assessment framework that equitably applies both perspectives. (shrink)

Pierre Bourdieu was one of the most influential social thinkers of the past half-century, known for both his theoretical and methodological contributions and his wide-ranging empirical investigations into colonial power in Algeria, the educational system in France, the forms of state power, and the history of artistic and scientific fields-among many other topics. Despite the depth and breadth of his influence, however, Bourdieu's legacy has yet to be assessed in a comprehensive manner. The Oxford Handbook of Pierre Bourdieu fills this (...) gap by offering a sweeping overview of Bourdieu's impact on the social sciences and humanities. Thomas Medvetz and Jeffrey J. Sallaz have gathered a diverse array of leading scholars who place Bourdieu's work in the wider scope of intellectual history, trace the development of his thought, offer original interpretations and critical engagement, and discuss the likely impact of his ideas on future social research. The Handbook highlights Bourdieu's contributions to established areas of research-including the study of markets, the law, cultural production, and politics-and illustrates how his concepts have generated new fields and objects of study. Natural resource management agencies in the United States have a legal responsibility to represent Indigenous Peoples and federally recognized Tribes in environmental stewardship. This comment article is a call to action that argues for genuine representation of Tribes and other Indigenous Peoples through adherence to existing, formal consultation policies and coproduction of knowledge. Agencies must recognize and respect the differences between public involvement and government-to-government consultation with federally-recognized Tribes. Sovereign tribal nations are not the public and have a unique relationship (...) with federal agencies based in the federal trust responsibility. Coproduction of knowledge is an emerging enterprise that has potential for meaningfully engaging and genuinely and equitably representing Indigenous Peoples and Tribes and should be codeveloped and implemented as policy. Agencies should build capacity to properly represent tribal nations in decisions. Agency employees and Indigenous Peoples must spend more time together to increase cultural awareness and build meaningful relationships to facilitate genuine consultation and coproduction of knowledge. While Aristotle is often lauded, especially by virtue ethicists, for his focus on and insight into virtue, a central aspect of his conception of virtue—the doctrine of the mean—is often derided as false if not indeed absurd. The reason for this disparity in reaction to Aristotle is that the doctrine of the mean has been severely misinterpreted as stating that there are a variety of parameters in which one must achieve a mean. Such a doctrine is false, but it is (...) not Aristotle’s. In this paper, the author gives a more accurate account of the doctrine of the mean than has heretofore been given. According to this account, the doctrine simply states that virtue disposes one to feel one’s passions with an appropriate intensity. The author closes by considering Hursthouse’s famous criticisms of the doctrine of the mean, and he shows that they fail to be reasons for rejecting the doctrine. (shrink)

This article presents empirical evidence to address how some visitors build relationships with a wildland place over time. Insights are drawn from qualitative interviews of recreation visitors to the backcountry at Rocky Mountain National Park in Colorado. The article describes relationship to place as the active construction and accumulation of place meanings. The analysis is organized around three themes that describe how people develop relationships to place: time and experience accrued in place, social and physical interactions in and with the (...) setting, and an active reflective process of regulating sense of identity to affirm commitment to place. In this commentary on Osiurak and Reynaud's target article, we argue that action is largely missing in their account of the ascendance of human technological culture. We propose that an action-based developmental account can help to bridge the cognitive-sociocultural divide in explanations of the discovery, production, and cultural transmission of human tool use.

The Peoples of the Arctic and Arctic health and sustainability are highly interconnected and essentially one and the same. An appropriate path to a sustainable Arctic involves a shift away from individual learning and achieving toward community leadership and the betterment of society. This article draws upon mindset theory from Western psychology and Indigenous relational accountability to propose and outline a model for achieving sustainability in the Arctic. The geographic focus is the North American Arctic. The principles of the argument (...) and the foundations of the model may apply across the Circumpolar North. The paper is a call to action for social scientists and policy makers in the Arctic to implement an Indigenous-led and self-determined social science. Empowering and supporting Indigenous leaders and scholars to direct and conduct autonomous social science research would inherently produce well-being and sustainability for Indigenous communities and regions. The arguments are supported by an inductive analysis of peer-reviewed literature, and the model is organized and illustrated using a schematic of concentric circles. The foundational elements of the model include: Indigenous sovereignty, Indigenous ontology, Indigenous models of sustainability, and Indigenous scholarship. Environmental scientists, resource managers, and policy makers are directed to better understand, accept, and support Indigenous science as a comprehensive and valid knowledge system; change how they use key terminology in research; rethink research roles; and amend processes and timelines for research development and funding. To achieve the desired outcomes for community well-being and Arctic sustainability, Arctic social scientists should seriously consider centering Indigenous science, especially in Indigenous communities. What would happen if we reimagined the humanities as the superhumanities? If we acknowledged and celebrated the undercurrent of the fantastic within our humanistic disciplines, entirely new cultural worlds and meanings would become possible. That is Jeffrey J. Kripal's vision for the future-to revive the suppressed dimension of the superhumanities, which consists of rare but real altered states of knowledge that have driven the creative processes of many of our most revered authors, artists, and activists. In Kripal's telling, the (...) history of the humanities is filled with superhumanist thought, possession states, and out-of-body experiences. The basic idea of the superhuman, for Kripal, is at the core of who and what the human species has tried to become over millennia and around the planet. After diagnosing the basic malaise of the humanities-that the truth must be depressing-Kripal shows how it can all be done differently. He argues that we have to decolonize reality itself if we are going to take human diversity seriously. Toward this pluralist end, he engages psychoanalytic, Black critical, feminist, postcolonial, queer, and ecocritical theory. He works through objections to the superhumanities while also recognizing the new realities represented by the contemporary sciences. In doing so, he tries to move beyond naysaying practices of critique toward a future that can embrace those critiques within a more holistic view-a view that recognizes the human being as both a social-political animal as well as an evolved cosmic species that understands and experiences itself as something super. To advance the philosophical debate of advertising's role in society, in this article I situate the natural tendencies of individuals that manifest themselves in economic relationships within the broader context of natural-law theory. I propose that a natural tendency to exchange goods underscores the classical liberal economic model. As a result, individuals have a natural inclination toward the use of persuasive rhetoric. In addition, as animale symbolicum, individuals have a natural tendency toward symbol use and creation, which in turn affects (...) the production and consumption of persuasive discourse. In light of these particular natural inclinations, I suggest that natural law can justify the institution of advertising. (shrink)

Individual scapetribing is identified as pointing the finger of blame at organizations (or groups, institutions, and systems) as a means of excusing or inaccurately ascribing responsibility for one's own actions and their consequences. This type of behavior is shown to be related to corporate scape-goating as described by Wilson (1993). The paper addresses responsibility ascriptions and the importance of corporate responsibility as a significantly influential multi-person system.

Thelen et al. not only offer an important new theoretical account of the Stage 4 object permanence error but provide the foundation of a new theory of cognitive development that is grounded in action. The success of dynamic field theory as a more general account of cognitive functioning, however, will depend on the degree to which it can model more generative capacities that are not limited to simple choice situations. This article places the concept of "right to know," which is normally associated with law, in a moral framework. It outlines multiple meanings of the concept, emphasizing the institutional nature of "right to know." Then the article imbeds this understanding in moral thinking, including a discussion of the moral elements of rights, and applies that understanding in specific journalistic situations.

In this paper I argue that, according to Plato’s Statesman, true statesmen directly control, administer, or govern none of the affairs of the city. Rather, administration and governance belong entirely to the citizens. Instead of governing the city, the task of the statesman is to facilitate the citizens’ successful self-governance or self-rule. Despite traditional viewpoints that see rhetoric as nothing more than a techné or bios, rhetoric may be viewed as being capable of instantiating basic human goods. This paper proposes that rhetoric motivates our capacities for action and brings the processes involved in action – including the bearing of practical reason on them – into accord with virtue, enabling us to exercise practical wisdom in and through prudential judgments so that when these judgments have a direct bearing on others we may (...) say that they are just. The comprehension of anaphoric relations may be guided not only by discourse, but also syntactic information. In the literature on online processing, however, the focus has been on audible pronouns and descriptions whose reference is resolved mainly on the former. This paper examines one relation that both lacks overt exponence, and relies almost exclusively on syntax for its resolution: adjunct control, or the dependency between the null subject of a non-finite adjunct and its antecedent in sentences such as Mickey talked (...) to Minnie before ___ eating. Using visual world eyetracking, we compare the time course of interpreting this null subject and overt pronouns (Mickey talked to Minnie before he ate). We show that when control structures are highly frequent, listeners are just as quick to resolve reference in either case. When control structures are less frequent, reference resolution based on structural information still occurs upon hearing the non-finite verb, but more slowly, especially when unaided by structural and referential predictions. This may be due to increased difficulty in recognizing that a referential dependency is necessary. These results indicate that in at least some contexts, referential expressions whose resolution depends on very different sources of information can be resolved approximately equally rapidly, and that the speed of interpretation is largely independent of whether or not the dependency is cued by an overt referring expression. Constitutive reflexivity, stories, and personal narrative were used to interpret leisure experience and provide insights for understanding leisure identity. I present a personal narrative of an annual canoe camping trip on a forested backcountry river. Stories are told in first person by the author about his trip of twenty years on a river with a small group of men. The author illustrates how personal narrative allows opportunities for understanding and interpreting meanings and changing leisure identities. The confluence of narrative, identity, (...) and leisure experience is illustrated and discussed. The purpose is to bring the writer/researcher into the qualitative project as a subject and actor in the story and show how leisure identity images are created and affirmed through time. (shrink)

Captured in narrative textual form through open-ended and tape-recorded interview conversations, visitor experience was interpreted to construct a description of visitors' relationships to place while at the same time providing insights for those who manage the national park. Humans are conceived of as meaning-makers, and outdoor recreation is viewed as emergent experience that can enrich peoples' lives rather than a predictable outcome of processing information encountered in the setting. This process-oriented approach positions subjective well-being and positive experience in the ongoing (...) processes and activities that comprise our life pursuits rather than in particular end states toward which behaviors might be directed as in the case of end state frameworks. Several themes emerged in the interpretation across narratives including a relationship of stewardship/sense of respectful mitigation, socially constructed dimensions of the wilderness concept, which both converged with and deviated from definitions in The Wilderness Act of 1964, humans positioned as both part of wilderness and separate from it, description of a process whereby people form a relationship to protected places, and an awareness among visitors of the overarching management dilemma of how to balance human visitation with protection. Management insights and general implications that emerged from the overall interpretation such as using narrative illustration to enhance visitor education were summarized. It is suggested that the particularities of the setting, in conjunction with the process-oriented creation of meaning via varying levels of physical and social interaction with the setting each play important roles, perhaps at different times, for visitors' relationships to places within the Park. The process of forming long-term relationships to places is highlighted as the common thread running through the interpretation. The value of the national park is seen to lie in these relationships, which are time and context dependent, not necessarily in the attributes of the park, many of which are generic to other protected areas in North America. The dissertation concluded with an evaluation of this interpretation based on these implications and insights and provided direction for further research to learn about the processes involved with forming relationships to protected places.
